1. Purpose of this legal notice

This legal notice identifies the parties involved in the website https://agenceauto.com and sets out the terms on which it is made available, in accordance with article 6 III of French Act no. 2004-575 of 21 June 2004 on confidence in the digital economy.

It applies to the entire site: editorial pages, vehicle listings, agency pages, forms and valuation tools.

This information is updated whenever the company’s statutory details change. The site is published in French; translations are provided for information only and, in the event of any discrepancy, the French version prevails.

2. Acceptance and amendments

Browsing the site constitutes acceptance of this legal notice. It may be amended at any time, in particular to reflect legal or technical developments: the applicable version is the one online at the time of consultation.

The terms governing our sales and brokerage services are set out in the general terms of service, which prevail over this document for anything concerning the performance of a mandate.

3. Access and availability

The site is accessible free of charge, excluding connection costs, 24 hours a day and 7 days a week, except during maintenance, updates or events beyond our control.

The publisher endeavours to give advance notice of scheduled interruptions but is not obliged to do so. No unavailability, whatever its duration, gives rise to compensation.

4. Our business and the scope of listings

L'Agence Automobilière acts as an intermediary in the sale of used vehicles: it brings sellers, mostly private individuals, together with buyers, and supports the transaction.

Listings are published for information purposes, on the basis of the information available when they go online. They may change and must be confirmed by the agency concerned. Publishing a listing does not, in itself, conclude a contract of sale between the buyer and the seller.

Photographs, mileage, equipment and prices are given subject to input error or changes in stock. A vehicle marked as sold remains viewable for reference.

5. Intellectual property

The structure of the site, its texts, graphic design, logos, illustrations and databases are protected by the French Intellectual Property Code. They belong to the publisher or are used under licence.

Any reproduction, representation, extraction or reuse, in whole or in part and on any medium, is prohibited without the prior written authorisation of L’Agence Automobilière. Systematic extraction of listing content, including by automated means, is expressly prohibited.

Manufacturer brands and logos remain the property of their respective owners and are used solely to identify the vehicles offered.

6. Personal data

Processing of personal data carried out through the site — contact forms, appointment requests, valuations, sales files — is described in the privacy policy, which sets out the purposes, legal bases, retention periods, recipients and how to exercise your rights.

Requests may be sent to the data protection contact at informatique@agenceauto.com. You also have the right to lodge a complaint with the French data protection authority (CNIL).

7. Cookies and trackers

The site places cookies that are strictly necessary for it to work and, subject to your consent, audience measurement and personalisation cookies.

Your choice is collected on your first visit and can be changed at any time from the consent management panel. Refusing non-essential cookies does not prevent you from using the site. Trackers and their lifetimes are listed in the privacy policy.

8. Hyperlinks

The site may link to third-party sites — finance and insurance partners, listing platforms, social networks. Those sites are independent: the publisher has no control over their content and accepts no liability for it.

Linking to the site is permitted for fair, non-commercial use, provided the link does not alter the content, does not create confusion as to the origin of the information and does not imply any endorsement. Any link may be removed on request.

9. Liability

The publisher takes the greatest care with the information published, without guaranteeing that it is error-free, exhaustive or continuously up to date. It cannot be held liable for indirect loss arising from use of the site.

Users are responsible for protecting their own equipment and for confirming with the relevant agency any information that is decisive for their commitment.

Online valuation tools provide an indicative estimate based solely on the data entered. It is neither a purchase offer nor an appraisal, and is not binding on the publisher.

10. Reporting unlawful content

In accordance with article 6-5 of French Act no. 2004-575 of 21 June 2004 on confidence in the digital economy (LCEN), manifestly unlawful content may be reported to siege@agenceauto.com.

To be actionable, a report must state the date, the exact address of the page, a description of the disputed content and the legal and factual grounds relied on.

11. Consumer mediation and dispute resolution

Under articles L. 612-1 et seq. of the French Consumer Code, in the event of a dispute, any consumer may use a mediation service free of charge with a view to an amicable settlement, after sending a written complaint to the publisher and failing a satisfactory reply within two months.

12. Service providers involved in the site

The following providers act on behalf of and under the responsibility of the publisher:

• OVH SAS — hosting of servers and databases, on infrastructure located in the European Union;
• R.G.A.I.X Tech — design, development, maintenance and technical operation of the platform, including monitoring;
• L'Agence WAM — search engine optimisation, audience measurement and editorial advice.

These providers act solely on the publisher’s instructions. Where they access personal data, they do so as processors within the meaning of article 28 of the General Data Protection Regulation, under a contract governing that access.

13. Governing law and jurisdiction

This legal notice is governed by French law. Failing an amicable settlement, any dispute concerning its interpretation or performance falls within the jurisdiction of the competent French courts.

Where the user acts as a consumer, they may bring proceedings either before the court of their place of residence or before the court of the publisher’s registered office, in accordance with the protective rules of jurisdiction applicable to consumers.
